Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the iHireFreelancer platform, including its software, tools, and associated services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

Persons who have not reached 18 years of age are not allowed to register with iHireFreelancer or use the Platform.

2. Platform/Availability

iHireFreelancer offers an internet-based service that enables Users to post or search for freelance jobs, communicate, and share relevant project information. We do not provide any guaranteed job or project placement, nor do we guarantee successful hires. Our service is limited to facilitating access to and communication on the Platform.

We will endeavor to keep the Platform available without significant interruptions. However, we cannot guarantee unlimited availability (e.g., downtime for maintenance or issues outside our control). iHireFreelancer is not responsible for interruptions caused by force majeure, third-party culpability, or other reasons beyond our control.

iHireFreelancer assumes no guarantee or responsibility for the accuracy or completeness of communications between Users on the Platform. Recipients bear responsibility for verifying the accuracy and completeness of all data obtained.

3. User Obligations

  • Accuracy of Information: The User bears sole responsibility for the content and accuracy of any profile, listing, or communication posted on the Platform. All information must be truthful. Misrepresentation or providing false information is prohibited.
  • Prohibited Content: Users may not upload or transmit sexual, pornographic, immoral, politically radical, or otherwise illegal content, nor content that violates the rights of third parties (e.g., copyrights, trademarks, personality rights).
  • Confidentiality: Users must handle emails and messages from other Users confidentially and not disclose them to third parties without prior written consent.
  • Permissible Use: Users may only use the Platform for its intended purposes (searching for or posting freelance opportunities, communication about projects, etc.). Collecting or extracting data from the database for commercial or non-intended purposes is strictly prohibited.
  • Software/Script Restrictions: The use of unauthorized scripts, robots, or crawlers to extract, copy, or modify data on the Platform is not permitted. Users must refrain from any action that could negatively impact the functionality of the Platform or infrastructure (e.g., overloading servers).
  • Backup Copies: Users should maintain current backup copies of any content, data, or communications they post or submit, to safeguard against data loss.

4. Fees, Membership, and Services

iHireFreelancer may offer free basic usage as well as additional paid features or memberships (“Premium Membership”) that provide expanded functionality. The specifics of such paid options, including fees, payment schedules, and features, will be displayed on the Platform.

By purchasing or subscribing to any paid feature, the User agrees to the posted pricing, billing, and payment policies. All fees are subject to change at any time, and such changes will be posted on the Platform. If you do not agree to the changes, you must cancel or discontinue use of the paid services. All sales and fees are generally final and non-refundable unless otherwise stated. Refund requests are handled on a case-by-case basis at iHireFreelancer’s sole discretion.

5. Web & App Development Services

In addition to connecting freelancers and potential clients, iHireFreelancer also offers its own professional web and app development services (“Development Services”). By engaging us for Development Services, you agree to the following:

  • Project Scope & Requirements: You (the client) must provide clear specifications and requirements for the project. iHireFreelancer will base its work on the information provided. Any changes or additional requests may result in adjusted timelines or fees.
  • Delivery & Acceptance: All deliverables (websites, applications, or other software) will be deemed accepted unless you provide written notice of any deficiencies within a specified period (e.g., 7 days) after delivery. iHireFreelancer will use commercially reasonable efforts to fix any reported issues promptly.
  • No Guarantee of Bug-Free Software: While iHireFreelancer strives to deliver high-quality code, it does not guarantee that the Development Services or deliverables will be free of errors, bugs, or interruptions.
  • Intellectual Property: Unless otherwise agreed in writing, all intellectual property rights in the final deliverables shall be assigned or licensed to you upon full payment of all fees. iHireFreelancer retains the right to use general knowledge, code libraries, and reusable components that do not contain your confidential information in future projects for other clients.
  • Third-Party Services: If the development requires integration with third-party APIs, libraries, or hosting providers, iHireFreelancer is not liable for any downtime, cost increases, or changes in terms imposed by those third parties.
  • Liability Limitations: iHireFreelancer shall not be liable for any indirect, incidental, or consequential damages arising out of or relating to the Development Services, even if advised of the possibility of such damages. This limitation applies to the extent permitted by law and is in addition to any other limitations of liability set forth in these Terms.

6. Limitations of Liability

To the fullest extent permitted by applicable law, iHireFreelancer and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the Platform or any services (including Development Services). This includes but is not limited to any damages for lost profits, business interruption, or loss of information.

iHireFreelancer’s liability for any claim is limited to a maximum of EUR 5,000 per claim unless otherwise agreed in a separate written contract for Development Services.

The above limitations do not apply if the damage arises from harm to life, limb, or health or if iHireFreelancer has acted intentionally or with gross negligence. Certain jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

7. No Guarantee of Project or Job Success

iHireFreelancer does not guarantee that Users will successfully find jobs, projects, or freelance opportunities via the Platform. We are not liable for the content of any project postings or User communications, nor for the suitability or outcome of any project or collaboration.

8. User Content and Communication

The User bears sole responsibility for all data and material (e.g., text, resumes, project listings) that the User uploads or communicates via the Platform. Users must ensure such content is lawful, does not infringe third-party rights, and is appropriate for a professional freelance marketplace.

iHireFreelancer shall not be liable for the accuracy or reliability of any data or materials uploaded by Users. Each User is responsible for verifying the accuracy and completeness of any information they receive.

9. Violations of These Terms

If iHireFreelancer has evidence of a User’s violation of legal regulations, third-party rights, these Terms, or other legitimate interests of iHireFreelancer, we reserve the right to:

  • Warn the User, remove or modify violating content, restrict the User’s access to certain features, temporarily or permanently block the User’s account, and/or terminate the User’s membership.
  • Take any further legal action deemed necessary.

We will consider the operational needs of the Platform, our liability risks, the legitimate interests of other Users, and the severity of the violation when deciding on such measures.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in or near Sozopol, Bulgaria. If you are a consumer residing in another EU member state, you may alternatively bring claims in the EU member state in which you live.

11. Term, Termination, and Refunds

These Terms take effect immediately upon your use of the Platform and remain in effect until terminated by either you or iHireFreelancer. We may terminate or suspend your access to the Platform at any time, without prior notice, for any reason (e.g., violation of these Terms).

If you have purchased a Premium Membership or paid service (including Development Services), the term and renewal policies will be clearly stated at the time of purchase. If you do not agree to any change in fees or features, you must cancel before the renewal date.

All sales and fees are generally final and non-refundable unless otherwise stated. Refund requests are handled on a case-by-case basis at iHireFreelancer’s sole discretion.

12. Additional Provisions

iHireFreelancer may update or amend these Terms at any time. If we make changes, we will post the revised Terms on the Platform and indicate the effective date. Your continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and iHireFreelancer regarding use of the Platform, superseding any prior agreements.
